Terms of Use

1. About these terms

These Terms of Use are an agreement between you and SirGutters (“SirGutters,” “we,” “us” or “our”). They cover sirgutters.com, its state sites such as georgia.sirgutters.com, the SirGutters phone number and the forms on the Site (together, the “Site”).

By using the Site, calling the SirGutters number or sending a form, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use the Site.

We may change these terms. When we do, we post the new version here and change the “Last updated” date at the top. If you keep using the Site after a change is posted, you agree to the new terms.

2. Words we use

“Homeowner” means anyone who uses the Site to find a gutter company, calls the SirGutters number or sends a quote request.
“Listed company” means a gutter company shown in the directory. Companies are listed for free, from what their own websites say.
“Participating company” means a gutter company, or a lead partner working with gutter companies, that has agreed with SirGutters to receive and pay for quote requests or calls. A company can be listed without participating, and participating doesn’t affect where or how a company is listed.

3. What SirGutters is, and isn’t

SirGutters is a free directory of independent gutter companies and a service that connects homeowners with participating companies. SirGutters isn’t a contractor. We don’t inspect, estimate, perform, supervise or guarantee any gutter work, and no company on the Site is our employee or agent.

Any agreement for gutter work is only between you and the company you hire. That company sets the price, does the work and is responsible for it. You’re responsible for checking a company before you hire it, including its license where one is required, its insurance and its references.

4. Listings, prices and other information

Listings are written from each company’s own website and show when we last checked them. We don’t verify licenses, insurance, reviews or work quality, and a listing isn’t a recommendation or endorsement. Companies are listed in order of distance, not by payment or quality.

Prices on the Site are typical ranges from published cost guides, shown with their sources. They aren’t quotes or offers. Local facts and guidance on the Site are general information, not professional, legal or engineering advice. Check rules such as permits and historic-district reviews with the city or county.

We work to keep the Site accurate, but information can be out of date or wrong. If you spot a mistake, tell us.

5. Quote requests and calls

When you send a quote request, you agree that SirGutters and participating companies may contact you about it as described next to the form, including by automated calls and texts at the number you gave. Agreeing isn’t a condition of buying anything, and you can withdraw it at any time by replying STOP to a text, asking a caller to stop, or emailing listings@sirgutters.com.

You agree to give your own true name and contact details, and only for a property where you can arrange gutter work. Don’t send a request for someone else without their permission.

Calls to the SirGutters number may be recorded and are connected to a participating company. Calling a company’s own number from its listing card reaches that company directly.

We don’t promise that a company will contact you, give you a quote or do the work, or that any company will be available in your area.

6. For listed companies

We list gutter companies from the information on their own websites, and we may show a company’s logo from its website to identify it. Names, logos and trademarks belong to their owners.

A company can ask us to add, update or remove its listing through the for-contractors page or by emailing listings@sirgutters.com. We check requested changes against the company’s website, and we honor removal requests. We may edit, decline or remove any listing at our discretion.

7. For participating companies

Companies that receive and pay for quote requests or calls do so under a separate agreement with SirGutters and under our Lead Return Policy. If that agreement conflicts with these terms, the agreement controls for those purchases. Participating companies agree to:

use a request or call only to contact that homeowner about the gutter work they asked about, unless the homeowner agrees to more;
follow every law that applies to contacting homeowners, including the Telephone Consumer Protection Act, the Telemarketing Sales Rule, do-not-call rules and state telemarketing and privacy laws;
honor a homeowner’s request to stop contact right away, and tell us about it;
not resell or share requests or calls with anyone else unless SirGutters agrees in writing;
keep homeowner information secure.

8. Using the Site

You may use the Site for your own, non-commercial use. You agree not to:

give false or misleading information, or pretend to be someone else;
send requests you don’t intend to follow up on, or send requests to test, flood or harm participating companies;
copy, scrape or collect listings or other content by automated means, or republish them, without our written permission;
interfere with the Site, its security or other people’s use of it;
use the Site for anything unlawful, or if you are under 18.

9. Our content

The Site’s text, design, photos, graphics and the SirGutters name and logo belong to SirGutters or its licensors and are protected by copyright and trademark law. We give you a limited, personal, revocable permission to view and use the Site under these terms. Nothing on the Site gives you any other right to use our content or marks.

10. Links to other websites

The Site links to companies’ own websites and to directories such as Google, BBB and Yelp. We don’t control those sites and aren’t responsible for their content, practices or privacy policies. A link isn’t an endorsement.

11. Disclaimer

THE SITE AND EVERYTHING ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON’T WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR MAKE ANY WARRANTY ABOUT ANY COMPANY, ITS WORK OR ITS PRICES.

12. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, SIRGUTTERS ISN’T LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, ARISING FROM YOUR USE OF THE SITE OR FROM ANY WORK, QUOTE, ACT OR OMISSION OF ANY GUTTER COMPANY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THESE TERMS WON’T EXCEED $100. SOME STATES DON’T ALLOW THESE LIMITS, SO THEY MAY NOT ALL APPLY TO YOU.

13. Indemnity

You agree to defend, indemnify and hold harmless SirGutters and its owners, employees and agents from any claim, loss or expense, including reasonable attorneys’ fees, that arises from your breach of these terms, your misuse of the Site or your violation of any law or the rights of others.

14. General terms

These terms, with our Privacy Policy and, for participating companies, the Lead Return Policy and their agreement with us, are the whole agreement between you and SirGutters about the Site. If any part of these terms can’t be enforced, the rest stays in effect. If we don’t enforce a part of these terms, we haven’t waived it. Any claim about the Site must be brought within one year after it arises, where the law allows that limit.
